1. Legal Framework and GDPR Compliance This Privacy Policy explains how we collect, process, and protect your personal data in connection with our automated parking services.

Data Controller Identity: The data controller responsible for processing your personal data is PARCTIC (Company registration number: 937560885 , Address: Grini Næringspark 4B, 1361 Østerås , Email: info@parctic.no, Phone: n/a).
Data Protection Officer (DPO): To ensure the highest level of data protection, we have appointed a Data Protection Officer. For any questions regarding your privacy, data processing, or to exercise your rights, please contact our DPO directly at dpo@parctic.no.

Notice of Camera Surveillance: Please note that all facilities operated by PARCTIC equipped with CCTV and Automatic Number Plate Recognition (ANPR) systems are clearly marked with physical informational signs at the entrances and throughout the parking areas, in accordance with the Norwegian Personal Data Act.


Our data processing is strictly governed by the General Data Protection Regulation (GDPR) and supplemented by Norway-specific legislation, including:
The Norwegian Personal Data Act (Personopplysningsloven), which regulates the use of CCTV and Automatic Number Plate Recognition (ANPR) systems.
The Norwegian Bookkeeping Act (Bokføringsloven), requiring us to retain specific transaction and payment data for up to 5 years.
The Norwegian Limitation Act (Foreldelsesloven), governing the retention of data related to unpaid claims and control sanctions.
The Norwegian Electronic Communications Act (Ekomloven), particularly § 3-15, which regulates our use of cookies and tracking technologies.
Industry-Specific GDPR Application: In the automated parking sector, your vehicle's license plate is classified as personal data. We process this data under the lawful bases of fulfilling a contract (GDPR Article 6(1)(b) - providing the parking service) and legitimate interest (GDPR Article 6(1)(f) - ensuring facility security, camera functionality, and enforcing parking terms).

2. Types of Data We Collect and How We Use It To operate our automated, AI-driven parking facilities, we collect and process specific categories of personal and technical data:
Customer Service and Communication Data When you contact our customer support team via email, phone, or our website contact forms (e.g., regarding invoice questions, complaints, or technical issues), we process your contact details and the content of your inquiry. Legal basis: Legitimate interest (GDPR Article 6(1)(f)) to provide effective customer service, resolve disputes, and improve our services.
Vehicle License Plates (ANPR Data): When you drive in or out of our parking facilities, our Automatic Number Plate Recognition (ANPR) cameras capture your license plate number. This is used to register the start and end times of your parking session, calculate fees, and seamlessly verify your active subscription or payment status.
Payment Information: When purchasing a subscription or paying for parking online or at a physical kiosk, we process your payment details (e.g., credit card masked numbers, transaction IDs) to securely facilitate the billing process.
Photographs for Control Sanctions (Blurred): If a control sanction (parking fine) is issued due to a violation of the parking terms, still photographs of the vehicle are taken to document the violation. To strictly protect your privacy, when these photographic files are sent to you alongside the fine receipt, any sensitive background information or bystanders in the image are deliberately obscured using a "blur" effect.
Live Video Monitoring and Error Analysis: We record and temporarily store live video footage from our parking facilities. This live video is retained for a maximum of 7 days and is never transmitted or shared with any third parties. The exclusive purpose of this 7-day video retention is technical diagnostics: it allows us to track whether the ANPR cameras are functioning correctly, verify if the AI successfully recognized the license plates, and monitor and analyze any potential system errors to improve recognition accuracy.
System Security and Fraud Prevention Logs To ensure the security of the PARCTIC E-platform and to detect, prevent, and troubleshoot abuse of our services, we collect technical logs. This includes your IP address, device information, browser type, and time of access when using our digital services. Legal basis: Legitimate interest (GDPR Article 6(1)(f)) to protect our IT infrastructure and prevent fraudulent activities.
Subscription and Account Data When you purchase a parking subscription (e.g., daily, monthly) via our E-platform (parctic.no), we collect the information strictly necessary to enter into and fulfill our Parking Agreement with you. This includes:
Personal Identification and Contact Details: First name, last name (or company name), email address, and phone number.
Vehicle Details: Vehicle registration number (license plate) connected to your subscription.
Billing Information: VAT number (for corporate entities) and necessary billing address details.
Recurring Payment Processing If you explicitly opt-in for automatic/recurring subscription payments, your payment card details (Visa or MasterCard) will be securely processed to deduct the subscription fee at the end of each billing cycle. Please note that PARCTIC does not store your full credit card details on our servers. The processing of secure online payments is handled directly by our certified third-party payment service providers (e.g., NETS or similar certified gateways) in full compliance with PCI-DSS standards. We only retain tokenized/masked references to your payment method to facilitate the recurring billing. You have the right to withdraw your consent for recurring payments at any time by contacting us.

Legal basis for processing: Fulfillment of a contract. If you act on behalf of a legal entity, our basis is legitimate interest to manage the customer relationship and fulfill contractual obligations.

3. Cookie Policy (Tracking and Analytics) We use cookies and similar tracking technologies on our website (parctic.no). Below is detailed information regarding our cookie usage:
For what purpose does the website use cookies? We use cookies for three main purposes: 1) Functionality (to remember your personal preferences, such as language and login sessions), 2) Analytics (to generate statistics on site traffic and analyze usage patterns to improve user experience), and 3) Advertising/Marketing (to target relevant advertisements to you on other platforms).
What data is collected—is it personal or anonymous? We primarily collect pseudonymous and anonymous data, such as your IP address, approximate geolocation, browser type, device information, and session statistics. Cookies do not directly identify you as an individual, but rather assign a randomly generated client identifier to your device.
Do we use analytics tools? Yes, we use Google Analytics to calculate visits and sessions, and to track overall user behavior on our site. We use specific cookies to distinguish between users and manage request rates.
Do we use marketing tags? Yes, we utilize the LinkedIn Insights Tag to analyze site traffic and provide targeted advertising based on your visiting patterns.
Is data transferred to third parties? Yes, data collected through analytical and marketing cookies is shared with third-party service providers (Google and LinkedIn) specifically to perform the services mentioned above. They process this data securely and in accordance with GDPR. We do not sell your data.
What types of cookies are used?
Strictly Necessary Cookies: Required for the core functionality and security of the website. These do not require consent.
Analytical Cookies: Used by Google Analytics to gather statistics.
Marketing Cookies: Used by LinkedIn Insights Tag for targeted advertising.

4. Your Rights Regarding Your Personal Data Under the GDPR and Norwegian law, you hold extensive rights concerning your personal data. You have the right to:
Request Access: You can ask for a copy of the personal data we hold about you (including parking history, passages, and billing data).
Request Rectification (Correction): You can ask us to correct any inaccurate or incomplete personal data.
Request Erasure (Right to be forgotten): You can request the deletion of your personal data, provided that we do not have a prevailing legal obligation to keep it (such as the 5-year retention rule under the Bookkeeping Act).
Right to Restriction of Processing: You can ask us to temporarily suspend the processing of your data (for example, if you contest the accuracy of a parking invoice and we need to verify it).
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format to transfer it to another service provider.
Right to Object: You have the right to object to processing based on our legitimate interests (e.g., direct marketing or certain types of profiling).
Right to Human Intervention (Automated Decisions & AI): As our parking facilities rely on AI-driven ANPR cameras for automated billing, you have the right to contest any automated decision (such as an incorrectly issued control sanction due to a camera misread) and request human review and manual correction of the license plate data.
Withdraw Consent: Where processing is based on your consent (e.g., for non-essential cookies), you can withdraw it at any time.
Right to Lodge a Complaint: If you believe our processing violates data protection laws, you have the right to file a complaint with the Norwegian Data Protection Authority (Datatilsynet) or, for cookie-specific issues, the Norwegian Communications Authority (NKOM).

5. Disclosure of Information to Third Parties To fulfill our obligations under the agreement with you and to ensure the proper operation of our automated facilities, necessary information may be disclosed to our trusted partners. We only share data with third parties that guarantee GDPR compliance. The following categories of entities may receive your data:
Payment Service Providers: Entities processing your credit card transactions and subscription payments (transferred data: payment details, transaction IDs).
Invoicing and Debt Collection Agencies: In cases of unpaid parking fees, control sanctions, or breach of contract, your data (name, address, license plate, unpaid amount, and evidence photos) may be transferred to Norwegian debt collection agencies (e.g., Riverty Norway AS, Kredinor SA, or similar) for recovery purposes based on our legitimate interest to enforce our claims
Alternative Payment Providers: In addition to standard card processors (Visa/Mastercard), we may share necessary transaction data with local payment solutions (e.g., VIPPS) if you choose them as your payment method.
Manual License Plate Correction Services: In rare cases where our AI cameras misread a heavily obscured or damaged license plate, still images may be securely transmitted to our verified subcontractors for manual correction to ensure accurate billing.
EV-Charging Partners: If you utilize electric vehicle charging stations within our facilities, relevant data will be shared with the charging operator (e.g., Zaptec, Easee) to facilitate the charging service and billing.
IT and Cloud Infrastructure Providers: Subcontractors providing server hosting (e.g., Microsoft Azure), database management, customer service platforms, and email/SMS distribution systems (e.g., Sendgrid, Twilio).
Public Authorities: We may disclose information, including ANPR data, to the Norwegian police or public authorities if we are legally obligated to do so (e.g., criminal investigations) or to verify vehicle ownership via the Norwegian Public Roads Administration (Statens vegvesen).

Data Processing Agreements (DPAs): In all cases where PARCTIC uses third-party subcontractors to handle your personal information (e.g., cloud hosting, payment gateways), the relationship is strictly regulated by legally binding Data Processing Agreements in accordance with GDPR Article 28. We only use data processors that provide sufficient guarantees to implement appropriate technical and organizational measures to ensure the protection of your data.

International Transfers: As a general rule, your data is processed within the EU/EEA. If any subcontractor processes data outside this area, we ensure it is done in compliance with the Norwegian Data Protection Authority's recommendations, utilising EU Standard Contractual Clauses (SCCs).

6. Data Retention and Deletion Policy We store your personal data only for as long as it is strictly necessary to achieve the purposes described in this policy, or as long as we are legally required to do so.
"Standard Parking Sessions and ANPR Data: For standard, fully paid parking sessions, ANPR data (including license plate numbers) and general CCTV recordings (if applicable) are retained only for a period strictly necessary for the purpose of the processing. Specifically, license plate data linked to successful transactions will be masked or anonymized after 3 months and permanently deleted after 2 years, unless a longer retention period is mandated by accounting legislation (up to 5 years) or for the establishment, exercise, or defense of legal claims (up to 3 years under the Norwegian Limitation Act)."
Active Subscriptions: Data related to your subscription (name, contact info, active vehicle) is kept for the duration of our customer relationship. If you cancel your subscription, the active profile data is deleted, except for data we must retain by law.
Accounting and Billing Data: In accordance with the Norwegian Bookkeeping Act (Bokføringsloven), all transaction data, invoices, and passage data necessary for tax and accounting controls are mandatorily stored for up to 5 years.
Unpaid Claims and Control Sanctions: Data related to unpaid parking fees or control sanctions (including blurred evidence photos and vehicle owner details) are retained until the claim is settled or until the claim is time-barred according to the Norwegian Limitation Act (Foreldelsesloven), typically 3 years.
Technical and Live Video Data: As explicitly stated, live video recordings used solely for technical diagnostics and AI error analysis are strictly retained for a maximum of 7 days and automatically permanently deleted thereafter.
Routine Parking and Passage Data (Anonymization/Masking) For regular parking sessions that are not tied to an active subscription or an unpaid control sanction (e.g., if parking was free, paid directly at a physical kiosk, or paid online within 48 hours), we apply strict data minimization. Passage data (ANPR records) is stored only as long as necessary to facilitate the payment, handle potential immediate complaints, and ensure correct IT system functioning. Unless accounting laws require otherwise, such routine passage data is routinely anonymized or deleted on an ongoing basis. Where applicable, specific identifiers (like license plates or phone numbers) are masked in our operational systems after 3 months and permanently deleted after 2 years, in line with industry best practices, unless required for ongoing dispute resolution.



GENERAL TERMS AND CONDITIONS FOR THE ONLINE PURCHASE OF A "PARCTIC" PARKING SUBSCRIPTION

General Information
These terms (hereinafter – the Terms) establish the procedure for the online purchase of a subscription (hereinafter – the Subscription) for the parking facility managed by PARCTIC (hereinafter – the Service Provider), applicable to natural or legal persons (hereinafter – the Buyer) who purchase the Subscription on the online platform (hereinafter – the E-platform, available at parctic.no), and constitute an integral part of the Agreement on the use of the Parking Facility between the Service Provider and the Buyer (hereinafter – the Agreement). The Agreement consists of the Buyer's application on the E-platform, these Terms, the Privacy Policy provisions approved on the E-platform and available at parctic.no (hereinafter – the Privacy Policy), and the Subscription activation notice from the Service Provider referred to in Clause 3.1.

The Buyer is a person who uses the E-platform to purchase a Subscription.
The Subscription grants the right to use the Parking Facility in accordance with the selected Subscription type (e.g., daily, 24-hour, monthly subscription).
The Subscription is a paid service that grants the Buyer the right to use one Parking Facility in a specific territory for one vehicle designated by the Buyer during the purchased period, in accordance with the terms of use of the respective Parking Facility, which are available both on the E-platform and on informational signs at the Parking Facility. The terms of use of the Parking Facility specify the Subscription types, minimum period, price according to the Subscription type, and other conditions. Prices are indicated in NOK, including VAT at the applicable rate. The informational signs at the Parking Facility provide only basic information, therefore the Buyer has an obligation to familiarize themselves with the full content of the terms of use of the Parking Facility on the E-platform.
The Service Provider reserves the right to unilaterally amend the Terms and the terms of use of the Subscriber parking facilities by notifying the Buyer at the e-mail address provided by the Buyer no later than 1 month before the effective date of the changes. The current version of the Terms is available on the E-platform: parctic.no. If the aforementioned changes apply to the Buyer's Subscription and the Buyer notifies the Service Provider in writing before the effective date of the changes that they do not agree to the changes in the terms mentioned in this clause, the Agreement is considered terminated upon receipt of the said Buyer's notice; otherwise, it is considered that the Buyer has agreed to the changes in the terms.
By making a Subscription purchase, the Buyer confirms that they have read and understood the Terms, the terms of use of the Parking Facility, and the Privacy & Cookie Policy.
Procedure for Purchasing and Paying for the Subscription
The purchase of the Subscription is carried out on the E-platform parctic.no by following the instructions in the "Subscription purchase" section.
When making a purchase, the Buyer selects the Subscription type, period, and provides the following data:
Name, surname, or legal entity name;
E-mail address and phone number;
Vehicle registration number;
For VAT payers: VAT number (if applicable).
The Buyer confirms that they have read the Terms, the terms of use of the Parking Facility, and the Privacy Policy by checking the respective checkbox on the E-platform.
Payment for the Subscription is made online using:
A bank card (Visa or MasterCard) by indicating the card number, expiration date, and security code;
A bank transfer by paying the invoice issued by the Service Provider, in which the invoice number must mandatorily be indicated.
The Buyer is responsible for correctly entering data in the Subscription application. The Service Provider assumes no liability for errors caused by incorrectly entered data (e.g., incorrect e-mail address or vehicle number).
Subscription prices may change until the Buyer has completed the purchase and made the payment.
In the event that the Buyer, upon concluding this Agreement, has checked the checkbox agreeing to automatic/recurring Subscription payment processing (deduction of the fee from the bank card), payment for the next Subscription period is automatically deducted from the payment card indicated by the Buyer on the last day of each Subscription month. The Buyer has the right to cancel this recurring payment arrangement at any time by sending a written notice to the Service Provider's e-mail address: support@parctic.no. Payment data processing is strictly handled by certified third-party providers in compliance with PCI-DSS standards, as detailed in our Privacy Policy. After receiving the notice, the Buyer shall pay for each subsequent Subscription period in accordance with the procedure set out in Clauses 2.1 - 2.6 of the Terms.
Recurring payments are made automatically once a month (or in another previously agreed period) based on the Subscription chosen by the Buyer. The payment date is set 5 days before the first day of the next Subscription term.
If, upon the occurrence of the payment term set out in Clause 2.8 of the Terms, there are insufficient funds on the payment card indicated by the Buyer, the payment is not executed, and the Subscription for the next payable term is terminated.
The Buyer will receive information about the next recurring payment no later than 3 days in advance to the e-mail address provided by the Buyer on the E-platform.
Terms of Subscription Delivery and Activation
After payment is made, the Service Provider sends a confirmation and Subscription activation information (e.g., a QR code or registration confirmation) to the e-mail address provided by the Buyer.
If payment is made by bank transfer, the invoice is sent to the Buyer's e-mail, and the Subscription activation information is sent after receipt of payment.
The Service Provider assumes no liability for the non-receipt of the confirmation or invoice if the Buyer has provided an incorrect e-mail address, or if the e-mail is blocked by the Buyer's e-mail filters, or if other obstacles exist.
The Buyer is responsible for presenting the Subscription confirmation (e.g., QR code) to the parking facility staff or the parking facility control system if necessary. The confirmation can be presented in a digital format (e.g., on a smartphone) or printed.
If the Buyer has not received the Subscription confirmation or invoice, they must inform the Service Provider by writing to the e-mail support@parctic.no, on business days from 9:00 to 17:00. After confirming the payment, the Service Provider will resend the confirmation.
Liability
The Service Provider ensures the availability of the parking facility in accordance with the Subscription terms, but may restrict access in certain emergency cases (e.g., due to technical reasons, repair works, or necessity for accident prevention measures), warning after the fact. In such cases, the money for the Subscription is not refunded, but the Service Provider may offer an alternative solution (e.g., extend the Subscription term).
The Service Provider may cancel the Subscription if there are reasonable grounds to suspect fraudulent activity. In such cases, the Buyer may be held liable in accordance with the applicable laws of the Kingdom of Norway.
The Service Provider is entitled to refuse or terminate the Subscription at any time if the Buyer violates these Terms and/or the parking facility's rules of use, and/or the laws of the Kingdom of Norway within the territory of the parking facility.
The Buyer confirms that they will not use third-party payment means without appropriate authorization and will comply with the rules of use of the parking facility.
The Buyer is prohibited from disclosing their access data to the E-platform, as well as the Subscription activation/confirmation information mentioned in Clause 3.1 to third parties, and assumes full liability for the consequences arising from the violation of this clause.
The Service Provider assumes no liability for damages incurred by the Buyer due to improper parking of the vehicle or violation of the rules of use of the Parking Facility, including penalties or vehicle evacuation.
The Service Provider is not liable for vehicle damage or theft at the Parking Facility, except in cases where the damage has occurred as a result of the Service Provider's own actions.
Other Provisions
In addition to what is mentioned in the Terms, the Service Provider has the right to terminate the Agreement without stating a reason by providing a 30-day prior notice to the Buyer.
The Buyer is prohibited from using the Subscription for commercial purposes without the written permission of the Service Provider. Copying or reselling the Subscription is prohibited.
Any disputes arising between the Buyer and the Service Provider shall primarily be resolved through negotiations. If an amicable agreement cannot be reached, the dispute shall be governed by and construed in accordance with the laws of the Kingdom of Norway and shall be submitted to the exclusive jurisdiction of the Norwegian courts.
Claims related to the Agreement shall be submitted by sending a free-form application to the e-mail support@parctic.no, indicating the Buyer's data and the justification for the claim.
If the Buyer is a consumer, in the event of an alleged breach of consumer rights, the Buyer has the right to submit a complaint to the Norwegian Consumer Council (Forbrukerrådet) or the Norwegian Consumer Authority (Forbrukertilsynet) for alternative dispute resolution.
Any Service Provider's notices sent to the e-mail address provided by the Buyer are considered written notices within the meaning of these Terms and have the same legal force as notices sent by mail.
A Party is released from fulfilling its obligations if the reason for this is force majeure circumstances that are beyond the Party's control and which the Party could not have foreseen. If such force majeure circumstances last for more than 30 days, either Party is entitled to unilaterally terminate the Agreement by a written notice to the other Party.
Right of Withdrawal
In accordance with the Norwegian Cancellation Act (Angrerettloven), a Buyer who is a consumer has the right to withdraw from this Agreement within 14 days of its conclusion without providing any reason, by sending a clear notification to the Service Provider via email at support@parctic.no. This right of withdrawal applies provided that the Buyer has not commenced the use of the Subscription. If the parking service has already been utilized within the 14-day period with the Buyer's prior express consent, the right of withdrawal is forfeited. Approved refunds will be processed using the same payment method the Buyer used for the initial transaction.
